If, after taking the evidence for the prosecution, examining the accused and hearing the prosecution and the defence on the point, the Judge considers that there is no evidence that the accused committed the offence, the Judge shall record an order of acquittal.
Sections of the BNSS are not classified one by one by any First Schedule. Part II of the First Schedule to the BNSS classifies offences under every other law by the punishment they carry — and the CRPC’s First Schedule sets out the same three bands.
If punishable with death, imprisonment for life, or imprisonment for more than 7 years.
If punishable with imprisonment for 3 years and upwards but not more than 7 years.
If punishable with imprisonment for less than 3 years or with fine only.
